Rachel’s bus accident settles for £20,000 (Glengormley) 

Rachel was involved in an accident while she was travelling on a bus on Antrim Road in Glengormley. Rachel had just boarded the bus and was taking her seat when another vehicle cut in front of the bus, causing the bus driver to take evasive action. The offending vehicle drove on following the incident. The sudden braking of the bus caused Rachel to be thrown backwards, colliding with a luggage rack. Rachel was assisted by other passengers and the bus driver, she subsequently attended Antrim Area Hospital in relation to her injuries.

Following a discussion with family members, Rachel decided to reach out to Paschal O’Hare. Our solicitor Chris quickly established that we could assist in bringing a claim for compensation arising out of the incident, and attended Rachel’s home address to take initial instructions.

As Rachel was a passenger on a bus, a letter of claim was directed to Translink in the first instance. Translink denied liability on the basis that the other vehicle had caused the incident. Attempts were made to identify the driver of the other vehicle. Although the incident was captured on CCTV, the registration of the other vehicle could not be deciphered.

In those circumstances, an application for compensation was made to the Motor Insurer’s Bureau (MIB).

We gathered Rachel’s medical records relating to the accident. She had attended a number of sessions of physiotherapy following the accident. An appointment was arranged for her to be examined by a Consultant Orthopaedic Surgeon, and the Consultant was provided with the notes and records from the various hospital attendances following the accident. Rachel was suffering from pain in her neck, back, shoulders, head and left arm as a result of the accident. The medical report documented the reduction of Rachel’s recreational activities as a result of her injury. The Consultant Orthopaedic surgeon diagnosed a fracture of the humerus and  related symptoms to the accident for a period of 18 months.

Upon receipt of the medical report, and following discussions, an offer of £20,000 was made by the Motor Insurer’s Bureau, which Rachel was delighted to accept.
