Mike’s Injury at a Water Park Settles for £170,000 (Belfast)

Mike was visiting a water park in Belfast when a day of fun turned into a nightmare. While participating in the bouncing castles activity, Mike’s toes became caught in an exposed attachment between the inflatables, causing a severe fracture and dislocation of his ankle.

He was taken by ambulance to the Royal Victoria Hospital and later transferred to Musgrave Park Hospital, where he underwent surgery to insert plates, screws, and pins in his foot. Several bone fragments were also removed.

Following his injuries, Mike developed post-traumatic arthritis, causing long-term pain that may require further surgery. A Consultant Psychiatrist diagnosed him with PTSD, and a Haematologist confirmed he had suffered a pulmonary embolism due to his injury.

The water park initially denied liability, arguing that Mike had signed a disclaimer. However, Partner Seymour Major and the team at Paschal O’Hare Solicitors rebutted this.

Successful Negotiation for a £170,000 Settlement

Prior to us issuing proceedings, the insurers then decided to agree to enter into settlement discussions on a without prejudice basis. Eventually, we were able to negotiate a figure in the sum of £170,000.

Partner Seymour Major commented: “This settlement was a great result for Mike, who faced significant hardship due to an avoidable accident. Businesses have a duty of care to their visitors, and we are proud to have helped Mike get the compensation he deserves to assist with his recovery.”
