Helen was employed by Kent Plastics in Enniskillen from 1976 to 1979, later working for STC in Enniskillen and Monkstown between 1980 and 1985, and then by Desmond & Sons in Enniskillen from 1985 to 2001. Throughout her time at these companies, Helen was exposed to excessive noise from factory machinery without adequate hearing protection.
Over the years, Helen began to notice a reduction in her hearing and developed tinnitus. Concerned about these symptoms, she visited her GP, who referred her to the hospital for further evaluation.

After considering whether her exposure to excessive noise during her employment might have caused her hearing issues, Helen contacted Paschal O’Hare Solicitors. We promptly arranged for Helen to undergo a hearing test, and the results were assessed by a Consultant ENT Surgeon. The Surgeon confirmed that Helen had noise-induced hearing loss. He prepared a medico-legal report, attributing a proportion of her hearing loss to each period of her employment.
With this evidence in hand, we initiated court proceedings against the insurers of each of Helen’s former employers. We served them with the medical report detailing her condition. The lead defendant sought to have Helen examined by their own Consultant ENT Surgeon, who agreed with our assessment and found that Helen’s hearing had been severely damaged due to the noise exposure at her workplace.
Following negotiations, a settlement figure of £28,300 was proposed. Helen was pleased to accept this amount, which compensated her for the hearing loss and tinnitus caused by her working conditions.
